Reportedly, Bayer is planning Monsanto's bankruptcy
According to the Wall Street Journal, citing insiders, the company is apparently considering filing for Monsanto's bankruptcy if a settlement with claimants for damages fails. Monsanto developed glyphosate and was acquired by Bayer for around $63 billion in 2018. According to the newspaper report, Bayer plans to settle some of the mass lawsuits against Roundup in a court in Missouri, where most of the lawsuits are pending. If Bayer were to file for Monsanto's bankruptcy, the bankruptcy petition would reportedly stop the lawsuits against Monsanto. This would be a significant relief to settle the liability for Roundup or glyphosate before the bankruptcy court, as reported by money.usnews.com citing Thomson Reuters.
So many US dollars have already been paid, so many cases are still pending
The chemical company has already paid around $10 billion to settle controversial claims that the glyphosate-based Roundup causes cancer. Approximately 67,000 more cases are pending for which the company has set aside $5.9 billion. As of January 31, 2025, Bayer has reportedly settled around 114,000 of the approximately 181,000 current lawsuits through settlements or they did not meet the requirements. The company claims to have won most of the lawsuits and is confident in its strategy.
How will the highest US court decide?
Last month, Bayer filed a petition with the US Supreme Court to limit the lawsuits and avoid potential billion-dollar damages. A decision could be made next month. According to Bayer, a positive ruling from the highest US court could largely end the legal disputes. The legal question in many appellate cases is whether claims based on alleged lack of warnings on the product, based on the law of individual US states, are precluded by federal law. Bayer believes that these claims are not valid. According to the US Environmental Protection Agency, Roundup is not carcinogenic, and the agency had approved the product without warning.
